DNAinfo reports that the Department of Buildings ruled against the new Upper West Side Duane Reade and determined that the use of their video billboard is illegal.  The DOB, who investigated the bright sign after neighbors complained and New York State Assemblymember Linda Rosenthal announced her opposition to the sign and sprang into action, determined that it is illegal due to a rule against “accessory signs” on the second floor.  In addition to violations issued by the DOB to the store, Duane Reade will need to bring the sign into compliance with regulations.  It is unclear at the moment whether the brightness will be reduced or the sign will be removed altogether.  The DOB’s ruling means the Duane Reade joins the Time Warner store at 96th and Broadway, which was also determined to be violating city regulations.  The store was forced to stop the flashing sign during night hours after Upper West Siders fought a similar video billboard.
