UWS Fairway Update: Overnight “Enhancements” At The Store

There was some overnight renovation at the UWS Fairway Market last night.

I presume these were improvements to address customer concerns related to recent video of rats inside the store.

I’d have more than the one photo below, but there was a confrontation between a store employee and myself that resulted in him calling security and threatening to remove me from the premises.

As the sign above indicates, the construction was centered in the store’s deli department.

It’s hard to tell exactly what was being done, but all the shelving/storage units in the area had been removed (they were on the street outside) and I think new ones were being installed.

This is consistent with several tweets sent out on Thursday by @FairwayMarket, which stated the following:

“Spending hundreds of thousands on new doors, reinforced walls\ floors, new produce cases, & more.”

DNAinfo had a brief write-up on Thursday.

A Fairway executive reached out to me yesterday afternoon (unsolicited) to provide an update as to what the store is doing to address customer concerns.

I haven’t had a chance to connect with him yet, but I hope to have an update posted by Monday.

As for my little run-in with Fairway staff last night… In many ways it’s not worth discussing, but I’d also be remiss if I completely ignored it.

Long story short, I walked into the store last night with a friend who needed to buy some things. I noticed the sign and heard construction, snapped a couple of pics and looked around.

I had every intention of simply posting an update this morning along the lines of “Hey, look — Fairway is trying to address customer concerns and make things better. More to come.”

Unfortunately, one employee felt compelled aggressively tell me I couldn’t take photos and to say I’d have to leave the store if I continued. He also called over “security” — a beefy man in a black t-shirt — who got between me the remains of the deli counter, behind which stood the other employee.

It takes quite a bit to rile me up, but I was pretty pissed off by the whole situation and more or less dared them to attempt to remove me from the store.

Thankfully, calmer heads prevailed among all parties and nothing happened.

I realize employees at the store are probably on edge, but I felt it was an unnecessary — and unwarranted — response.

I’ll repeat here what I said to him last night:

“If you guys are trying to make improvements to the store to address customer concerns, you should be encouraging people to see those efforts — not threatening to kick them out.”

I was, and still am, a Fairway customer (although I’m not buying olives there any time soon).

I will not hold the entire chain responsible for the poorly chosen words of one employee who’s probably had a rough couple of days.

As I’ve written in previous posts, I actually feel bad for Fairway, as I think other grocery stores and markets deal with the same issues, even if they’re not necessarily caught on video.

While I’ve inadvertently kicked up a media shit-storm (see: NYT, WSJ, Daily News, NY Post, ABC, CBS, NBC, PIX, Fox, Gothamist, Huffington Post, NY Mag, Late Show With David Letterman, and others), I’ve tried my best to provide an unbiased take on the situation at the store and will continue to do so.

Like I said, someone reached out to me yesterday to discuss what steps are being taken and I hope to have an update on that in the coming days.

MyUpperWest has been ground-zero for Fairway’s PR nightmare (NOT my intention), but I am more than willing to give them a platform to reach out to customers and explain what they’re doing to address the situation.

    Fairway has never allowed the taking of photographs in the store…it’s not because of the rat situation…it’s been a long-standing policy – one that you were violating. They were completely within their rights to call over security when you didn’t stop.

    Hi David,

    I fully appreciate that not everyone has an equal interest
    in this story, but MUW has thousands of readers beside you.

    Based on all the e-mails and comments I’m receiving, I
    believe a majority of them do not share your thoughts regarding “giving
    up” on this issue (although I have no doubt you’re not alone).

    I feel especially compelled to follow up on it and provide
    Fairway a platform to respond to customers’ concerns.

    As I outlined in the post above, this site has inadvertently
    served as a lightning rod for all the negative press that Fairway is getting.

    That was never my intention and I will not simply muckrake
    and then disappear.

    I don’t believe any of the major media outlets who reported
    on the story care about the underlying issues or what’s being done to resolve
    them, nor do I believe most of them will do any sort of follow-up. All they
    care about is the sensationalism.

    My own opinion is that the entire situation has been blown
    out of proportion and Fairway is being somewhat unfairly victimized for a
    problem that I’m sure affects other UWS and NYC businesses.

    However…

    Since MyUpperWest is strictly focused on the neighborhood
    and serves as an informational resource for many customers with a strong
    interest in Fairway’s response, I will continue to post updates on the
    situation when warranted.

    I admit that coverage has been especially heavy over the
    past few days – and there will likely be several more updates over the coming
    days as the situation sorts itself.

    There will also be more non-Ratgate posts.

    My apologies if this particular subject is boring you, but I
    can’t please everyone all the time and don’t intend to try.

    There’s obviously a lot more happening on the Upper West
    Side than just this one story and I will continue, as I always have, to focus
    on the broader neighborhood going forward.

    I hope you’ll stick around.

    Hi Susan,

    I have a few responses:

    1) I’m not saying it’s not there, but I’ve never seen signs indicating photographs are not allowed.

    2) If that’s true, it’s an absurd and ridiculous policy. It’s not a military institution with government secrets. It’s a supermarket.

    3) Perhaps most importantly, I don’t believe any of the employees actually witnessed me taking pictures — the photos I took were in a different part of the store. I was asking one of workers a question about the renovation when he saw I was holding my cell phone. He then proceeded to get unnecessarily aggressive.

    I’m telling you as objectively as I can, their response was unwarranted and served no purpose.

    I found the entire episode frustrating for a variety of reasons, especially because I was taking photos to try and highlight that the store is making an effort to respond to customer concerns and make improvements.

    You’re welcome to your own opinion, but those are the facts.

    Fairway is really sliding, while the rat is clearly an unfortunate issue
    that could happen to any supermarket(face it this is NYC and rats are
    everywhere), they clearly are not covering the olives, or keeping a
    clean store. They’ve also stopped valuing customers as they’ve raised
    prices on many items by unconscionable amounts. Many items have
    virtually doubled in the past two years as they pay for expansions, a
    700 basis point over libor private equity loan and attempt to show
    higher profit margins ahead of a planned public offering. It’s really
    unfortunate as only a couple of years ago Fairway was a terrific
    community asset offering premium products at low prices, but those days
    are gone.

    Personally, I have been very interested in your coverage of this whole Fairway rodent/hygiene issue. As someone who has shopped there regularly for more than a decade, to say that it was disturbing to see the videos was to put it mildly. But I’d rather know the reality, which is, as you’ve noted, probably the case with a lot of other food retailers in the city and elsewhere (and given the rat problem of the UWS and the ongoing construction and other issues, it probably should be expected.) But I am grateful that you took the time and effort to post and, as we’ve seen, it takes just one match to light a firestorm of media coverage. Lest anyone doubt it, the reason Fairway is taking (whatever) actions now is because of the media attention. It might have ignored one blogger but not the local and national media. Over the years, regardless of food retailer, I”ve never purchased products from open bins or even those with tops. The reason? I’ve observed the sickening (Literally) behavior of adults and children who put their hands directly into bins (whether grains, bread, etc.) to remove items. Hello? How were these people raised that they don’t realize that one’s germs are now contaminating an item? It’s bad enough when very little children do this (I continue to see this all the time. It’s what kids do, but it’s the reasons need to keep a tight rein on their kids.) but it is unreal when you see adults, who should know better, do it. The fact that they are working on the deli area (where they sell behind-the-counter cut meats and prepared items) makes me now concerned that even this area has been problematic. And we shop a lot from that area! Yea, there’s a lot of other things going on on the West Side. But this is important coverage. I’ll be very interested to hear what they have to say when you contact them. They should have been in contact with you (and your readers) from their first knowledge of the post. Meanwhile, as for pix. I don’t know what the law is/isn’t as regards consumers photographing in stores here or elsewhere. But you’re right, what IS the big deal? And if there is no sign specifically stating some sort of “No Photographs” policy, then you had every right to take a photo. There are reasons one cannot photograph or videotape in concerts. It’s another thing entirely when stores don’t want people taking pix. One, alas, suspects the worst.

    I’ve never seen a sign about no photography in the store, and I have taken many photos there myself (food or cute kid related, not rodent) with no problem. It’s much more likely that Fairway didn’t want you to take pictures because you might catch another rat and they are under the misguided notion that no rat photos = no rats. So now they made up this no photography policy so that the customers taking photos will be the bad guys, not the store itself who has ignored this problem for YEARS. I returned bread to them a couple of years ago that had evidence of rodent – bag was chewed through, a hole chewed in the loaf, etc. They were arrogant then and they are arrogant now. Fairway has always been dismissive of individual customer complaints. They seem only responsive to continued media pressure, so please keep it up.

    I’ve walked by/through this Fairway several times in recent days, and my sense is that the growing realization that it has a vermin problem is really hurting their sales. The aisles seemed much much less crowded today than is typical for them on a Saturday. And the stores smells of disinfectant to a degree which I cannot ever recall it smelling of before this story broke. Too little, too late, or do its customers have short memories?

    The only reason I know this is that my father tried to take pics inside several years ago, and was told that it was not allowed. Celebrity privacy was the reason given. My gym (Reebok) has the same policy, for the same reason.
